These Terms of Use ("Terms") govern your access or use, from within the United States and its territories and possessions, of the applications, websites, content, products, and services (the "Services," made available in the United States and its territories and possessions by Beerd Bus Brew Tours LLC and its parents, subsidiaries, representatives, affiliates, officers and directors (collectively, "BeerdBus"). PLEASE READ THESE TERMS CAREFULLY, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND BEERDBUS. In these Terms, the words "including" and "include" mean "including, but not limited to."
By accessing or using the Services, you confirm your agreement to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. BeerdBus may update or amend these Terms at any time.
BeerdBus does not advocate or encourage the abuse of alcoholic beverages. Please drink responsibly and with moderation.
We do not, under any circumstances, accept responsibility for any damages or injury to yourself, property, or anyone else due to the consumption of alcoholic beverages, use of our services, or the use of this site and any materials located on it. We cannot take any responsibility for the effect of alcoholic drinks on people.
Smoking (including the use of eCigarettes, vape pens, etc.) is not permitted on the bus.
Cancellation Policy
Salt Lake City Tours: Cancellations made at least 24 hours prior to the scheduled tour time are eligible for a 100% refund minus the cost of the Salt Lake Brewery Pass unless otherwise agreed upon. No refund if cancelled with less than 24 hours notice of the scheduled tour time.
Ogden Tours: Cancellations made at least 24 hours prior to the scheduled tour time are eligible for a 100% refund. No refund if cancelled with less than 24 hours notice of the scheduled tour time.
Nondiscrimination Policy
We are committed to creating inclusive and safe experiences for all who take part in the services offered by BeerdBus; despite their sexual orientation, gender identification, race, ethnicity, faith, accessibility, etc. We welcome all people with genuine enthusiasm and open minds. Discrimination, harassment, prejudice, racism, and hatred have no place on our bus or in our community. If any guest(s) are being disrespectful, making others feel uncomfortable, or acting in a discriminatory nature of any kind, we reserve the right to terminate their tour immediately without refund.
Repair & Cleaning Fee
If you materially damage the bus (including vomiting or other bodily fluids), you shall be responsible for the cost of repair or necessary cleaning of the bus in excess of normal "wear and tear" damages and necessary cleaning ("Repair or Cleaning"). BeerdBus reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning using the payment method designated during checkout.
Limitation of Liability
BeerdBus shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including personal injury, loss/theft of personal property, or property damage, related to or in connection with, or otherwise resulting from any use of the Services. BeerdBus shall not be liable for any damages, liability, or losses arising out of your use of the Services.
Indemnity
You agree to indemnify and hold BeerdBus and its affiliates and their officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees), arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the Services; (ii) your breach or violation of any of these Terms; or (iii) your violation of the rights of any third party, including Third Party Providers.
